1. Their arbitrators have not adhered to the terms of contracts that prohibit counsel representation.
2. Their arbitrators have refused to issue reasoned rulings which may expose and document their incompetence.
3. Their arbitrators have complimented claimants legal expertise and case presentation, then ruled that both claimants must bear their own arbitration costs even though the claimant paid in full for both parties and the respondent paid nothing and was allowed to fully present their losing defense.
4. Their arbitrators have refused to allow for the proceedings to be recorded whilst ignoring contractual provisions that all proceedings will be recorded.
In my opinion, contractors should steer clear of the American Arbitration Association till such time that their arbitrators comply with the law and the contracts arbitrated before them.
